What do we mean by ‘legal basis’?

Please note that we may not be able to provide you with our website services if your data is processed to fulfil a contract or a legal obligation and you do not provide the requested data.
Data sharing and international transfers
As explained in this privacy policy, we use various service providers who help us to deliver our services and ensure the security of your data. When we use these service providers, it is necessary for us to share your personal data with them.

- In the event of unlawful processing, you object to the erasure of the personal data and instead request that the use of the personal data be restricted.
- We no longer require your personal data for the purposes of processing, but you require your personal data to establish, exercise or defend your legal claims, or
- after you have objected to the processing, for the duration of the assessment as to whether our legitimate grounds override your interests.
4. Right to erasure (‘right to be forgotten’) (Art. 17 GDPR)
If any of the following grounds apply, you have the right to request the immediate erasure of your personal data:
- Your data is no longer necessary for the purposes for which it was originally collected.
- You have withdrawn your consent and there is no other legal basis for the processing.
- You have objected to the processing and there are no overriding legitimate grounds for the processing, or you have objected in accordance with Article 21(2) of the GDPR.
- Your personal data is being processed unlawfully.
- Erasure is necessary to comply with a legal obligation under Union law or the law of the Member State to which we are subject.
- The personal data was collected in connection with information society services offered in accordance with Article 8(1) of the GDPR.
Please note that the above grounds do not apply where processing is necessary:
- To exercise the right to freedom of expression and information.
- To fulfil a legal obligation or to carry out a task carried out in the public interest to which we are subject.
- For reasons of public interest in the area of public health.
- For archiving purposes in the public interest, scientific or historical research purposes, or for statistical purposes.

5. Right to data portability (Art. 20 GDPR)
You have the right to receive your personal data in a structured, commonly used and machine-readable format, or to request that it be transferred to another controller.
6. Right to object to certain processing (Art. 21 GDPR)
You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you carried out on the basis of Article 6(1), first sentence, points (e) or (f) of the GDPR. This also applies to profiling based on these provisions.
Where personal data concerning you is processed for the purposes of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purposes of such marketing; this also applies to profiling insofar as it is related to such direct marketing.
7. Right to lodge a complaint with a supervisory authority
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority if you consider that the processing of your personal data infringes the GDPR.
The supervisory authority to which the complaint has been lodged shall inform the complainant of the status and outcome of the complaint, including the possibility of a judicial remedy under Article 78 of the GDPR.

Provision of the website and creation of log files
1. Description and scope of data processing
Every time our website is accessed, our system automatically collects data and information from the computer system of the accessing device.
The following data is collected in this process:

The data is deleted as soon as it is no longer required to fulfil the purpose for which it was collected. In the case of data collected for the purpose of providing the website, this is the case once the relevant session has ended.
Where data is stored in log files, this occurs after seven days at the latest. Storage for a longer period is possible. In this case, users’ IP addresses are removed or anonymised so that it is no longer possible to identify the client making the request.

Scope of personal data processing
We use the FACT-Finder plug-in from Omikron Data Quality GmbH, Habermehlstr. 17, 75172 Pforzheim, Germany (hereinafter: FACT-Finder). If you have JavaScript enabled in your browser and have not installed a JavaScript blocker, your browser may transmit personal data to FACT-Finder. This involves your shopping history, in particular items and product categories that you have viewed, searched for or purchased. This may result in personal data being stored and analysed, primarily relating to the user’s activity (in particular, which pages have been visited and which elements have been clicked on) as well as device and browser information (in particular, the IP address and the operating system). Die Zwecke und Mittel der Verarbeitung personenbezogener Daten beim Besuch unserer Facebook-Seite https://de-de.facebook.com/herma/ („Facebook-Seite“) werden von der HERMA GmbH, Heinrich-Hermann-Straße 14, 70794 Filderstadt, Deutschland („ HERMA GmbH“) und Facebook Ireland Ltd. 10.4.1.5 Rechtsgrundlage für die Verarbeitung personenbezogener Daten
Soweit für Verarbeitungsvorgänge personenbezogener Daten eine Einwilligung der betroffenen Person eingeholt wird, dient Art. 6 Abs. 1 S.1 lit. a (DSGVO) als Rechtsgrundlage für die Verarbeitung personenbezogener Daten.
Bei der Verarbeitung von personenbezogenen Daten, die zur Erfüllung eines Vertrages, dessen Vertragspartei die betroffene Person ist, erforderlich ist, dient Art. 6 Abs. 1 S.1 lit. b DSGVO als Rechtsgrundlage. Dies gilt auch für Verarbeitungsvorgänge, die zur Durchführung vorvertraglicher Maßnahmen erforderlich sind.
Soweit eine Verarbeitung personenbezogener Daten zur Erfüllung einer rechtlichen Verpflichtung erforderlich ist, der HERMA GmbH oder Facebook unterliegt, dient Art. 6 Abs. 1 S.1 lit. c DSGVO als Rechtsgrundlage.

10.4.2 Verarbeitung personenbezogener Daten durch HERMA GmbH
10.4.2.1 Zweck der Datenverarbeitung
HERMA GmbH unterhält Onlinepräsenzen innerhalb sozialer Netzwerke, um mit den dort aktiven Interessenten und Nutzern zu kommunizieren und diese dort über unsere Produkte, Veranstaltungen und Neuigkeiten informieren zu können. Wenn Sie unsere Facebook-Seite aufrufen (unabhängig davon, ob Sie in Ihrem Facebook-Konto eingeloggt sind oder nicht), überträgt Ihr Browser technisch bedingt bestimmte Daten an den von Facebook verantworteten Webserver. Als Betreiber der Facebook-Seite kann HERMA GmbH mit Hilfe der Funktion Facebook Page Insights, die uns Facebook als nicht abdingbarer Teil des Benutzungsverhältnisses kostenfrei zur Verfügung stellt, anonymisierte statistische Daten betreffend die Besucher unserer Facebook-Seite erhalten. Diese Daten werden mit Hilfe der von Facebook gesetzten Cookies gesammelt, die jeweils einen eindeutigen Benutzercode enthalten und den Facebook auf dem Endgerät der Besucher speichert. Der Benutzercode, der mit den Anmeldungsdaten solcher Nutzer, die bei Facebook registriert sind, verknüpft werden kann, wird beim Aufrufen der Facebook-Seite erhoben und verarbeitet.

Tendenzen in den Bereichen Alter, Geschlecht, Beziehungsstatus und berufliche Situation, Informationen über den Lebensstil und die Interessen seiner Zielgruppe und Informationen über die Käufe und das Online-Kaufverhalten der Besucher seiner Seite, die Kategorien von Waren oder Dienstleistungen, die sie am meisten interessieren, sowie geografische Daten, die ihn darüber informieren, wo spezielle Werbeaktionen durchzuführen oder Veranstaltungen zu organisieren sind, und ihm ganz allgemein ermöglichen, sein Informationsangebot so zielgerichtet wie möglich zu gestalten. Zwar werden die von Facebook erstellten Besucherstatistiken ausschließlich in anonymisierter Form an HERMA GmbH als Betreiber der Facebook-Seite übermittelt, jedoch beruht die Erstellung dieser Statistiken auf der vorhergehenden Erhebung – durch die von Facebook auf dem Endgerät der Besucher gesetzten Cookies – und der Verarbeitung der personenbezogenen Daten dieser Besucher für diese statistischen Zwecke. 10.4.2.3 Datenlöschung und Speicherdauer
Personenbezogenen Daten werden gelöscht oder gesperrt, sobald der Zweck der Speicherung entfällt. Eine Speicherung kann darüber hinaus noch erforderlich sein, wenn dies durch den europäischen oder nationalen Gesetzgeber in unionsrechtlichen Verordnungen, Gesetzen oder sonstigen Vorschriften, denen HERMA GmbH unterliegt, vorgesehen wurde. Wir werden aber diesbezüglich die weitere Entwicklung beobachten und diese Datenschutzerklärung gegebenenfalls entsprechend anpassen.
